These terms and conditions outline the rules and regulations for the use of LAFITA's Website, located at https://www.lafita.ae.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Lafita signage & wayfinding if you do not agree to take all of the terms and conditions stated on this page.

1. Definitions

We and us mean Lafita.

You means the client or visitor.

Proposal means our written scope, drawings, quotation, programme, and commercial terms.

Order means your written acceptance of the Proposal or our Order Confirmation.

Deliverables means signage, wayfinding, facades, glass works, and related documentation we supply.

2. Scope

These Terms apply to the website and to any Proposal and Order issued by us. If there is any conflict, the Proposal and Order govern that project.

3. Website use

You may browse the site for your own business use. You must not misuse the site, attempt to gain unauthorised access, or copy content except as permitted below. We may change or suspend the site at any time.

4. Information on the site

Content is for general information. It is not a commitment to deliver a specific outcome unless expressly stated in a signed Proposal or contract. Catalogues, images, finishes, and examples are illustrative.

5. Your responsibilities

Provide accurate information, site access, and timely decisions. Supply brand assets, colour references, and signatures needed for submissions. Ensure power, structure, and access equipment are available as stated in the Proposal, unless we have agreed to supply them.

6. Surveys and site conditions

Our survey records measurements, photos, access, and risks at a point in time. Hidden conditions, changes after survey, or non standard requirements may require a variation to scope, price, or programme.

7. Design and drawings

Concepts, mockups, and drawings remain our intellectual property until fully paid. You may use them only for the agreed project. Any reuse requires our written consent. We will issue approval ready drawings as set out in the Proposal.

8. Approvals and compliance

We manage submissions to regulators and landlords where stated in the Proposal. Approval timing is outside our control. You authorise us to submit on your behalf and you supply all corporate documents and signatures required. Final responsibility for lawful operation of signage at the site remains with you.

9. Orders and changes

An Order is formed when you accept our Proposal in writing or we issue an Order Confirmation. Changes after Order must be agreed in writing. Variations may affect price, programme, and method. We will not proceed with changes without written instruction.

10. Pricing and payment

Prices and payment milestones are as stated in the Proposal and Order. All taxes, duties, and fees are additional unless noted. Late payment may pause work and delivery. Title to Deliverables passes to you only when amounts due are paid in full.

11. Delivery and installation

We will deliver and install as set out in the Proposal. Dates are planned with you and depend on timely approvals, access, and third party performance. We install with safe methods and clean handover. Risks from unrelated trades, power outages, or site closures are outside our control.

12. Risk and title

Risk in the Deliverables passes on delivery to site. Title passes on full payment. Until title passes, you must keep Deliverables secure and unmodified.

13. Materials and finishes

We select materials and finishes to meet the Proposal and site conditions. Natural variation in surfaces and colours may occur within commercial tolerances. Where exact colour matching is critical, we will issue a sample for your written approval.

14. Warranty

We provide a five year structural warranty and a two year illumination warranty as standard, unless the Proposal states otherwise. Warranty covers defects in materials and workmanship under normal use. It excludes damage from misuse, power surges, unauthorised repair, third party work, accidents, and lack of cleaning or maintenance.

Warranty service requires access to the site during normal hours. We will respond within forty eight hours for sites within our normal UAE service coverage.

15. Maintenance and aftercare

We offer preventive maintenance plans and on demand support. Cleaning and inspection intervals depend on location and environment. Failure to maintain may void warranty where the issue arises from lack of care.

16. Intellectual property

All concepts, drawings, specifications, methods, photographs, and text on the site and in our submissions are owned by us or our licensors. You may not copy or reuse them except for internal evaluation or for the agreed project after fees are paid.

17. Content you provide

If you provide logos, artwork, or text, you confirm you have the right to use them and grant us a licence to use them to deliver the project and for case studies unless you opt out in writing.

18. Third party services

Links to third party services such as WhatsApp, maps, or file sharing are provided for convenience. Their terms and privacy practices apply when you use them. We are not responsible for their content or availability.

19. Confidentiality

Each party must keep the other party’s non public information confidential and use it only for the project, except where disclosure is required by law.

20. Data protection

Our use of personal data is described in our Privacy Policy. By contacting us, you consent to us using your details to respond and to deliver services.

21. Liability

We are responsible for direct loss proven to result from our breach of these Terms or negligence, subject to the limits below. We are not liable for loss of profit, revenue, opportunity, or any indirect or consequential loss. Our total liability for a project is limited to the amount you paid for the affected Deliverables.

Nothing limits liability for death or personal injury caused by negligence or for fraud.

22. Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control. Examples include extreme weather, floods, fires, strikes, supply chain disruption, regulatory actions, epidemics, and power or network outages. We will notify you and resume performance as soon as practicable.

23. Cancellation and suspension

If you cancel or suspend after Order, you agree to pay for work done, committed materials, and reasonable demobilisation costs. We may suspend for non payment or material breach after notice if the breach is not cured.

24. Marketing credits

We may show non confidential photos and high level project details in our portfolio and marketing unless you ask us not to in writing before handover.

25. Governing law and disputes

These Terms and any dispute are governed by the laws of the United Arab Emirates. The parties submit to the exclusive jurisdiction of the competent courts of the United Arab Emirates unless another forum is agreed in writing.

26. Changes to these Terms

We may update these Terms from time to time. The latest version will be posted on this page with the effective date. For live projects, the Proposal and Order in force at the time of Order apply unless both parties agree to adopt a new version.
